Apple and Psystar should resolve some of their differences amicably. The agreement, which must be approved by the judge, provided that the Mac clone will continue to sell machines, but they should not contain Mac OS X.
Everyone is benefiting
This decision is sure what might happen to the best of both companies. Psystar spared many months of trial and a decision that will surely against him (cf."Psystar loses his first trial"). The firm may continue to operate and benefit from the buzz it has created around his trademark.
Apple avoids, in turn, create a martyr and take the role of Goliath relentlessly against a little David. It also ensures that Psystar stop selling machines embedding its operating system. The firm can not prevent consumers from installing Mac OS X, but that is another problem. With this agreement, Cupertino gets the message that he is the only one who can officially sell computers embedding its operating system, which has always been the goal of the firm since the return of Steve Jobs.
All is not finished
Psystar has also agreed to pay damages to Apple. The amount was not disclosed, but should remain symbolic given the low sales of the Mac clone (see "Psystar: 768 machines sold ...") and the fact that the firm is currently in receivership. The two companies are also bound by a trial in Florida that Apple is trying to quash, arguing that the facts found are identical to those of the trial in California. The agreement does not on the Rebel EFI, a software solution Psystar to install Mac OS X on any machine as long as it integrates the hardware is compatible with the application.
