Elan has asked the American committee in charge of amendable international trade ban of the iPad, but the MacBook, Magic Mouse, iPod touch and iPhone, the firm approximations that Apple is violating its patents.
The Taiwanese gaining momentum
The patent in question relates to the detection of two or more fingers. The Taiwanese have already filed complaints against Apple in a court of justice in California, but this new process aims to import the products to the apple on the U.S. market from its Asian factories, not damages, unlike the first trial.
It is clear Elan has serious arguments in its favor since a court ruled in his favor in the case against in Synaptics and wearing the same patent.
The Bold and the trial
The ITC has 30 days to say whether the complaint is allowable. If the judge believes it is, it will take about 15 months before he makes his decision. In short, this complaint should not affect the launch of the tablet, but it shows once again the difficult condition in which industry is located. Nokia, Kodak, Apple and HTC are all tangled in a knot of trial on different technologies and Elan shows that the ball prosecution is not about to stop.
