Dell disproves allegation that it was preservation of facts in link with a long-running case charging the PC maker of eagerly selling faulty PCs. Web hosting service provider Advanced Internet Technologies filed a action reproving Dell of maintenance of facts and failing to produce credentials in its possession, according to a court filing. AIT's activity required sanctions against Dell.
"We oppose with AIT's argument that we desecrated the detection order and will be filing our reply with the Court shortly. Dell receives all court orders and our duty to obey with them very critically," said David Frink, a Dell spokesman.
The documents wanted by AIT are in link with a case condemning the PC maker of selling thousands of desktop PCs in spite of knowing the PC enclosed faulty components.
AIT filed the case next to Dell in the U.S. District Court for the Eastern District of North Carolina in 2007 and is seeking $75,000 and corrective damages from breach of contract, fraud and illusory business
