The trial of the German software giant SAP over alleged industrial espionage is as planned on 1 November start. Judge Phyllis Hamilton dismissed the plaintiff's application and SAP rival Oracle, the first trial, on the 4th November move. In a decision published on Friday while the judge refused the request from SAP to miss the lawyers on both sides of a muzzle outside the courtroom. SAP is concerned that Oracle will use the process as a stage to reinforce his verbal attacks against the Germans.
Oracle CEO Larry Ellison is notorious for his sharp words against the competition. SAP is the number one provider of business software, Oracle is number two. Since the acquisition of mainframe computer manufacturer Sun Ellison goes on and heavy artillery against the computer manufacturer HP and IBM. SAP had changed at the last moment his defense strategy and is now being contradicted even the accusation that the company management was aware of unfair data retrieving a U.S. subsidiary of the Oracle Web site.
