A U.S. International Trade Commissionjudge in his initial judgment determined that the HTC had breachedtwo Apple patents, according to the announcement made by HTC onFriday. The decision of the judge is final and HTC may be banned inthe near future from importing phones to the U.S.
This is indeed the newest bang on theoperating system of Google`s Android, which has been sooner or laterattacked by its competitors namely Apple, Microsoft and Oracle. Theinitial determination would soon be analyzed by another panel of ITCjudges who can either uphold the decision or discard it.
According to Florian Mueller who is apatent expert, said that the two patents appear to be basic toAndroid. In his blog post, he quoted, “They are very likely to beinfringed by code that is at the core of Android.” Adding to thefury, he said that this patent is the bone of contention betweenApple and Motorola.
Thus, in this situation Apple has theoption to license its technology to HTC. However, it seems contraryas HTC has the patents, which are required by Apple. In addition, HTCannounced that it didn’t have full knowledge about the opinion andit had plans to devalue the decision.
Grace Lei, general counsel for HTCissued a statement quoting, “Apple filed suit on 10 of its patentsagainst HTC, but based on the judge's initial decision today onlyprevailed on 2 of those patents. HTC will vigorously fight these tworemaining patents through an appeal before the ITC Commissioners whomake the final decision.”She added, “We are confident we havea strong case for the ITC appeals process and are fully prepared todefend ourselves using all means possible.”
HTC added that ITC has judged all; theApple breached patents that were accredited to S3Graphics. HTC is inthe process of acquiring, S3Graphics as a component of its separateinvestigation strategy.Android is also being bashed by othersources as well. Microsoft has also approached numerous Androidhandset makers appealing them to license their technology. Till date,HTC is the biggest vendor they have amassed.
Apart from this, Oracle is alsobattling with Google on breaching its Java patents and Copyrights inthe Android version. Apple has also filed an accusation against otherAndroid Handset makers like Samsung.
